Subscription Agreement

This Subscription Agreement (“Agreement”) governs your subscription to and use of Stamper Australia Inc.’s services (“Services”). This Agreement is entered into between Stamper Australia Inc., an Australian company (“Stamper”), and you (“Customer”), either individually or on behalf of an entity you represent.

1. Acceptance and Scope

By accessing or using our Services, or by clicking “I Accept” or signing an Order Form, you agree to be bound by this Agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind the entity.

2. Services Provided

Stamper provides digital loyalty program infrastructure and analytics tools to help businesses manage customer engagement. Services include:

  • Access to the Stamper platform

  • Loyalty card system and backend analytics

  • Customer interaction data tracking and reporting

All data collected via the Stamper platform is owned and managed solely by Stamper. Customers are granted access to insights and reporting but do not own or control raw data.

3. Subscription and Fees

  • Customer agrees to pay all applicable subscription fees as outlined in the Order Form or on the Stamper pricing page.

  • Prices are subject to change without notice.

  • Payment must be made via approved payment methods.

  • Failure to maintain an active payment method may result in suspension of Services.

4. Termination

  • This Agreement remains effective until the subscription is terminated.

  • Stamper may suspend or terminate any account, at its sole discretion, at any time and without notice.

  • Upon termination, the Customer’s access to the Platform and Services will end, and no further data will be accessible.

5. Availability and Support

  • Stamper aims for 99.8% uptime excluding planned maintenance.

  • Support is available via email (info@stamper.com.au) with responses typically within 48 hours.

6. Customer Responsibilities

  • You are responsible for the security of login credentials and ensuring only authorized users access the Platform.

  • You must comply with all applicable laws, and may not use the service for illegal or unauthorized purposes.

7. Data Protection and Privacy

  • Stamper applies industry-standard security measures to protect Customer data.

  • Customers must not upload sensitive personal information such as government IDs or health data.

  • Use of Services is also governed by our Privacy Policy.

8. Confidentiality

  • Both parties agree to keep confidential any proprietary or sensitive information disclosed during the term of the Agreement.

9. Intellectual Property

  • Stamper retains all rights, title, and interest in the Services, software, and analytics tools.

  • Customers may not reproduce, modify, or distribute the Service or its components without prior written consent.

10. Limitation of Liability

  • Stamper is not liable for indirect, incidental, or consequential damages.

  • Stamper’s total liability under this Agreement will not exceed the amount paid by the Customer in the past 12 months.

11. Governing Law

This Agreement is governed by the laws of the State of Victoria, Australia. Disputes shall be resolved in the courts located in Melbourne, Victoria.

12. Modifications

Stamper may update this Agreement at any time. Continued use of the Services after changes are made constitutes acceptance of the revised terms.
