These Terms of Use (“Terms”) govern your access to and use of Stamper’s services, including our website https://www.stamper.com.au, mobile applications, and digital platforms (collectively, the “Platform”). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

Stamper provides data-driven solutions for businesses to track customer activity and encourage repeat engagement through loyalty programs. This includes:

  • A digital customer loyalty card system allowing businesses to reward repeat visits, purchases, or other behaviors.

  • Analytics dashboards and reporting tools that help businesses understand customer trends and improve performance.

All systems, data collection tools, loyalty cards (digital or physical), and related services are supplied by Stamper. Stamper retains sole ownership and control of all data collected or processed through the Platform. Clients may view and act on reports and insights but do not acquire ownership or portability rights to the raw data.

2. Subscription and Payment

  • Services may be offered on a subscription or usage-based model. Specific pricing will be shared during onboarding or through Stamper’s customer portal.

  • Stamper reserves the right to adjust its pricing at any time and without notice. Continued use of the service after a pricing change constitutes acceptance of the new rates.

3. Termination

  • Stamper may suspend or terminate your access to the Platform, remove your account, or discontinue the Service entirely, at its sole discretion, and without prior notice.

  • Stamper may do so for any reason, including but not limited to: violation of these Terms, suspected abuse, failure to comply with laws, or at its own operational discretion.

4. Intellectual Property and Data Ownership

  • All content, software, analytics, dashboards, branding, and data processed or generated by Stamper’s system is the sole property of Stamper.

  • Clients are granted a non-transferable, limited license to access and use the Platform strictly for their own business operations during the term of their subscription.

  • No ownership or rights to Stamper’s systems or data are granted beyond usage access.

5. Privacy and Compliance

Use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your data. By using the service, you consent to these practices.

6. Acceptable Use

Clients must not misuse the Platform. Prohibited activities include reverse-engineering, unauthorized data access, reselling the service, or interfering with its normal operation. Clients are responsible for any misuse originating from their accounts.

7. Disclaimers

The Stamper platform is provided “as is.” We do not guarantee that the service will be error-free or uninterrupted. While we aim to provide high availability and accurate analytics, Stamper is not liable for any business decisions made based on the Platform’s data or insights.

8. Limitation of Liability

In no event will Stamper be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities. Our total liability is limited to the amount paid by you in the previous 3 months for the service.

9. Governing Law
